TERMS AND CONDITIONS


1. Introduction

Welcome to Standard Loans Kenya. By accessing our website, using our loan calculator, or applying for any loan product, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding with any loan application.

These Terms and Conditions apply to all loan products offered by Standard Loans Kenya, including Personal Loans, Business Loans, Home Loans, Mortgages, Construction Loans, and Equity Release Loans.


2. Eligibility Criteria

To qualify for any loan product from Standard Loans Kenya, you must meet the following minimum requirements:

Personal Loans:

  • Be at least 18 years of age

  • Be a Kenyan citizen or legal resident

  • Have a valid National ID or Passport

  • Have a verifiable source of income

  • Have an active bank account in Kenya

  • Provide proof of employment or business income for the last 3 months

Business Loans:

  • Business must be registered in Kenya

  • Minimum 6 months of business operations

  • Valid business permit or trading license

  • Business bank account in the business name

Home Loans & Mortgages:

  • Minimum age of 18 years, maximum age at loan maturity is 65 years

  • Property must be located within Kenya

  • Confirmed source of income to support repayments

  • Acceptable credit history with no active defaults


3. Loan Application Process

Step 1 – Application
You submit a complete loan application through our website, in person, or via our authorized agents. All information provided must be accurate, truthful and complete.

Step 2 – Verification
Standard Loans Kenya reserves the right to verify all documents submitted, including identification, bank statements, payslips, and any other supporting documentation.

Step 3 – Assessment
We conduct a thorough credit assessment based on your income, existing obligations, credit history, and repayment capacity. This assessment determines your loan eligibility and maximum loan amount.

Step 4 – Approval
If your application is approved, you will receive a formal loan offer letter outlining the loan amount, interest rate, repayment period, fees, and other terms. You must sign and return the offer letter within the stated validity period.

Step 5 – Disbursement
Upon acceptance of the offer and completion of all conditions, funds will be disbursed to your nominated bank or M-Pesa account within the stated timeframe.


4. Interest Rates & Fees

Interest Rates:

  • Personal Loans: Interest rates are determined based on your credit score and risk profile. Rates range from 12.5% to 18% per annum on a reducing balance.

  • Standard Mortgages: 13.33% per annum on reducing balance

  • Business Loans: Rates determined individually based on business financials

Fees & Charges:

  • Loan Processing Fee: 1% – 55% of loan amount (non-refundable)

  • Valuation Fee: 0.25% of property value (for mortgages)

  • Legal Fees: Applicable for property charges and discharges

  • Early Repayment Fee: 3% of outstanding balance (if paid off within first 12 months)

  • Late Payment Penalty: 5% of the overdue amount plus interest on arrears

  • Statement Fee: KES 100 per statement (if requested more than once per month)

Standard Loans Kenya reserves the right to change interest rates and fees at any time with written notice to existing customers.


5. Repayment Terms

Repayment Methods:

  • Standing order or debit order from your Standard Loans account

  • Salary check-off (for eligible employers with a check-off agreement)

  • Direct bank transfers

  • M-Pesa PayBill or Till (for small loan amounts)

Repayment Schedule:

  • Personal Loans: Monthly installments over 1 to 96 months

  • Business Loans: Monthly or quarterly installments over up to 60 months
  • Home Loans: Monthly installments over up to 25 years

Late Payments:
If you fail to make a payment on time, Standard Loans Kenya may:

  • Charge late payment penalties

  • Report the delinquency to credit reference bureaus

  • Accelerate the loan (demand full repayment immediately)

  • Commence legal recovery proceedings

  • Seize collateral or charged property


6. Security & Collaterals

For Personal Loans:
No collateral is required. However, Standard Loans Kenya retains the right to demand security if your credit assessment indicates higher risks.

For Business Loans:
Security may include:

  • Directors’ personal guarantees

  • Business assets charge

  • Property charge

For Home Loans & Mortgages:
A first legal charge over the financed property is required as security. The property will be registered in your name with Standard Loans Kenya noted as the chargee.

Insurance Requirements:

  • Credit Life Insurance is mandatory for all loans

  • Property insurance is mandatory for all home loans and mortgages

  • Insurance must be with Standard Loans Kenya approved insurers


7. Information Sharing

Standard Loans Kenya is registered with all major Credit Reference Bureaus (CRBs) in Kenya, including:

  • TransUnion Kenya

  • Metropol CRB

  • CRB Africa

By accepting these Terms and Conditions, you consent to:

  • Standard Loans Kenya sharing your credit information with CRBs

  • CRBs sharing your credit report with other financial institutions

  • Standard Loans Kenya accessing your credit report during application and throughout the loan term

Default or late payment may negatively affect your credit score and ability to access credit from other institutions.


8. Loan Calculation

Our loan calculator provides estimates only and does not constitute formal loan offers. The actual loan amount, interest rate, and fees may differ based on:

  • Your credit assessment results

  • Verification of your income and documents

  • Current market conditions

  • Standard Loans Kenya’s lending policies at the time of application

You should not make financial decisions based solely on calculator estimates.


9. Data Protection

Standard Loans Kenya complies with the Kenya Data Protection Act, 2019. We collect, store, and process your personal data only for legitimate purposes related to your loan application.

Your Rights:

  • Access your personal data held by us

  • Request correction of inaccurate data

  • Request deletion of data (subject to legal retention requirements)

  • Withdraw consent for data processing (may affect loan approval)

We do not sell or share your personal data with third parties except:

  • Credit Reference Bureaus (as stated in Section 7)

  • Legal and regulatory authorities (when required by law)

  • Service providers who assist in loan processing (under confidentiality agreements)


10. Default & Recovery

If you default on your loan repayments, Standard Loans Kenya may take the following actions:

Personal Loans:

  1. Send written notice of default

  2. Impose late payment penalties

  3. Report default to CRBs

  4. Instruct external debt collectors

  5. File a civil claim in court

  6. Obtain a judgment and garnishee order against your salary or bank account

Home Loans & Mortgages:

  1. Send statutory notices as required by law

  2. File a suit for recovery of the outstanding amount

  3. Apply for an order of sale of the charged property

  4. Exercise statutory power of sale to recover the debt

You will be responsible for all legal costs and collection fees incurred by Standard Loans Kenya in recovering the debt.


11. Loan Restructuring

If you experience financial difficulty, you may request loan restructuring. Standard Loans Kenya will consider:

  • Extending the loan repayment period

  • Temporarily reducing monthly installments

  • Granting a payment holiday (subject to terms)

To apply for restructuring:

  • Submit a written request explaining your financial situation

  • Provide supporting documents (e.g., termination letters, medical reports)

  • Demonstrate genuine hardship with intent to repay

Restructuring approval is at the sole discretion of Standard Loans Kenya and may attract additional fees.


12. Early Repayments

You have the right to repay your loan early, either partially or in full.

Partial Early Repayments:

  • Minimum partial repayment of 25% of outstanding balance

  • Reduces principal and future interest

  • No penalty for partial repayment

Full Early Repayments:

  • If repaid within the first 12 months: 3% penalty on outstanding balance

  • If repaid after 12 months: No penalty

  • You save on future interest charges


13. Amendments to Terms

Standard Loans Kenya reserves the right to amend these Terms and Conditions at any time. Amendments will be communicated:

  • Via email to registered customers

  • Through notices on our website

  • Through SMS notifications

Continued use of our services after amendments constitutes acceptance of the new terms.


14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Kenya, including:

  • The Banking Act (Cap 488)

  • The Central Bank of Kenya Act (Cap 491)

  • The Data Protection Act, 2019

  • The Land Act, 2012

  • The Movable Property Security Rights Act, 2017

Any disputes arising from these Terms shall be resolved through:

  1. Internal complaints resolution process

  2. The Banking Ombudsman of Kenya

  3. Arbitration in accordance with Kenyan law

  4. The courts of the Republic of Kenya

16. Definitions

Term Definition
Loan Amount The principal amount borrowed from Standard Loans Kenya
Interest Rate The annual percentage rate charged on the outstanding balance
EMI Equated Monthly Installment – the fixed monthly payment amount
Collateral Asset pledged as security for the loan
Charge A legal claim over property as security for a debt
Default Failure to make a scheduled repayment on time
Arrears Overdue payments that have not been made
Credit Rating An assessment of your creditworthiness based on repayment history

17. Acceptance

By submitting a loan application, using our loan calculator, or signing a loan offer letter, you acknowledge that:

  • You have read and understood these Terms and Conditions

  • You agree to be bound by them

  • All information you provide is true and accurate to the best of your knowledge

  • You consent to credit checks and data sharing as described

  • You understand that default may result in legal action and credit score damage
